Fired for Marrying a Porn Star

As per the title, a town manager was fired over his marriage to a porn star.

I think an alternative headline would have been "Lawsuit Waiting to Happen".

Per the article, the guy was doing a good job, but the town council feared his marriage would cause "disruptions" and voted unanimously to fire him "without cause". The thing is, the guy had already been married to the porn star for almost a year, and he was still doing his job effectively. Moreover, their relationship evidently stretches back further than that, as the articles states that "they have three children".

However, here is the most damning piece of the article and why I think there will be a lawsuit: "[Mayor] Kiker acknowledged that [Town Manager] Janke had violated no rules or laws and added that he had done a good job for the island town." If you are doing your job well, why should it matter that you married a porn star? Is there anyone out there who thinks this guy doesn't have a legitimate beef?

 

Surely this deserves a raise if anything? talk about well played.

 

I'm thinking jealousy played a part in that one...

The article did state that there is a section in the town charter that gives the Council the authority to fire people. So I do not think they did anything illegal.

However, there are many instances where companies have had similar wording with their employment agreements with thier workers, but that does not necessarily preclude a former employee from bringing a "wrongful termination" civil suit against the company.

Ummm...teenage children??? Something tells me these two have been together for a *lot* longer than a year.

This guy should sue the pants off the council...no pun intended.

 

He should let the wife do that, she's the expert...

 

Whatever their contract says, he might be able to challenge it on Constitutional grounds. Who a person is married to shouldn't be the business of the employer except under very limited circumstances of security or conflict of interest.

 

I agree LKD. Her profession as a porn star should have nothing to do with it. For them to remove him from his position, there has to be underlying issues of either or both hatred and resentment toward his wife. To me, it is unjustifiable to fire him. If has has teenage kids with her, they new before they hired him what they were getting into or they did a very poor job on the background check/interview upon hiring. Either way, that's their mistake and they are wrong for firing him on that basis only.

 

Guess it depends where they were filming

 

Many entities that are worried about reputation also include so-called 'morality clauses', defining rights to termination given by certain behavior that the employer believes would reflect poorly on the entity's reputation. In that case, marrying a porn star could qualify, as could having children out of wedlock (though I generally think conditions are specified in the contract). That being said, it doesn't look like there was anything like this in this case.

Meh, we'll see.

Seriously, though, this guy should get some kind of a compensation. It wasn't a problem for so long, he was doing a good job, and now that? IF anyone has to worry about their reputation, it's him. Knowing that everyone not only saw your wife naked but has been masturbating to her porn flicks may be a bit of a turn-off.

 

City managers in Florida can pretty much be replaced at will for no reason, and it is frequently done, even when the person in the position is doing well at the time.

That said, this one stinks like rotten fish, and is likely to become a major PR mess for Ft Myers beach. It doesn't surprise me though, most of this state is pretty socially conservative, and things like this happen frequently.

 

I'm very Pro-Life and thus somewhat socially conservative (often live and let live on other issues like gay marriage-which I support).

I think they should give him his job back with an apology and a bonus.


Or he could run for city council/mayor.

 

I really don't understand how the occupation of a family member is of consequence. I understand that if a judge's brother is in the mafia, we certainly can have some question on the judge's impartiality. But we're talking about a porn star here, not Al Capone.

Yeah, some guys saw her naked haveing sex with people. What does that have to do with her husband's capability to do his job? It's not like HE was the porn star (although I still wouldn't see how that would affect hs job).

His boses were quoted as saying he did a good job. So the only reason he was fired is of judgemental reasons ''Oh, what about the kids? THINK ABOUT THE KIDS!''... C'mon, the USA is the biggest consummer of pornographic material. They should stop being hypocrites.
