I disagree.

I would consider a woman getting a string of orgasms from oral sex against her will a rape. It's not about the technical part, it's about consent.

 

The same way even a bluff threat leading to intercourse is rape. Some lawyers will probably argue that there must be some reasonable probability behind the threat, but I still maintain that any non-consensual sex is rape, no matter what. It's even possible for a rapist not to enter any physical contact with the victim at all - he may, for example, threaten two people into having intercourse (psychos come up with such things). In this case, there are two people having sex and two victims (no matter even if that were the most exciting experience they've ever had) and the rapist may well be a virgin. That is, until he meets Bubba.

Hmm... I know of a country where that would be possible, but isn't it limited to cases in which one person takes advantage of the other? If they go there together and get wasted together, some degree of consent is given and it's equal in both parties. One person might even get drunk enough to take advantage of the passed out one. The act itself is hardly consensual if it's not even conscious, also no specific consent has been expressed nor can one even be asked, but it still doesn't really look a rape. Of course, stuff that happens at college-style parties when you're dumb enough to fall asleep is still rape. Much like on a sheep, though.

 

In the United States, acts performed by a person while intoxicated or high has no relevance on the punishment of a crime. An intoxicated person who hits a kid while driving will suffer the same punishment as a sober driver.

Basically, the law states that you accept responsibility for your bad judgement and behavior when you decide to become drunk. You are completely responsible for your behavior - excusses are never accepted in U.S. courts.

Getting a woman drunk to the point where she engages in consentual sex, is not rape unless her mental abilities are restrained against her will.

 

According to US law, that would be statutory rape. IIRC, it carries a lesser penalty, but it's still rape. Simply being drunk makes her mental abilities be restrained.

IIRC, it depends on the situation. If the sober driver did the crime intentionally, then you'd be correct. If it was an accident, then the sober one would face a lesser charge.
