Injury

    I have some kinda muscle injury in my left arm from my job. It must be something to do with the heavy lifting or something. I am going to see my doc tomorrow morning. I have a feeling he is going to say I need to take a month off or something. Now because I injured myself at work lifing weights 2 manned that are not allowed by law, does this mean my employer has to pay me while I am off? I'd guess he will try to sack me or make me redundant. I don't know how it works, I guess it is different outside of the UK though. I've been looking for info on this all night and I can't find nothing.

    If you can prove he forced you or at least required you to carry more than the law allows, then you should be able to sue him for a hefty sum. If the bastard fires you, you sue him. But if you lifted more than you should because you wanted to do the job faster, then he has nothing to do with that. Don't know how it works in your system, but you'd better ask the doctor to write some statement about your injury - what it is, how it was inflicted, etc.

    Don't know how it is in your system, again, so I can't tell you if there's a law obligating him to pay you while you're off, but if he weren't obligated to pay you, he would still be liable for your lost wages if he exploited you up to the point of you hurting yourself using illegal methods.

    Just make sure you can prove he made you carry that much and that you followed his orders and that's how you got injured.

    Not much you can do other than suing. If the bastard made you carry more than the law allows, he isn't really the guy to pay you just because the law so demands. Especially if he's likely to try to fire you.

    In the US, if you get injured on the lob, not only does your employer have to pay for the medical bills, but they usually have to pay you for the time you have to take off. Workers comp is great for employes, but sucks for the employers.

    I used to work with a girl you got hit by a car while at work. She was cleaning the parking lot when some idiot went the wrong direction through the drive through and not only hit her, but pinned her up against another (parked) car. She was out of work for almost 6 months laying on her couch and getting paid for it, not to mention the nice lawsuit she filed against the idiot who hit her. :rolling:

    Yes I can prove it no problem. I don't know if the weights are allowed or not allowed. I am just assuming that they are not. I am sure there is a weight limit in the health and safety rules in the UK somewhere and I would be 99% sure that what we lift exceeds it but I don't know anything for certain. I am not aware of health and safety rules. This is really not good for me. If it is something bad like tendonitis then what happens to my guitar playing? I don't know about suing him, people here get around 2 grand compensation for loss of fingers so what would I get for a bit of tendonitis or whatever? Screw all. It wouldn't be worth it.

    This should be able to give you an assessment of what your risk is. The load allowance is dependent on how often you have to lift it but anything higher than 50 kg's is of concern.
    Bags of sand/cement used to be 25kg but have been reduced in recent years (& no longer tell you how much they weigh) meaning it's rather difficult to judge quantities for cement and concrete.

    It is loads higher then 50kg's for sure, much much bigger.

    What the hell are you lifting by hand that is loads over 50kg?
    Surely there some sort of equipment available for that?
