    Shosh,
don't you know that lawyers often disagree? Where have you been the last decade or so?

Besides, what you say she says is still wrong.

    Gaear,
you are aware that this case is different than the ones you describe? Different case, different result.

I was on one jury a few years ago on which I somehow became the foreman. Normally I get dismissed from jury duty because of my job. In relation to work, I've testified at numerous hearings and trials. I very often prepare reports and submit other materials in support of various cases that are used as evidence at trial. These are most often for civil proceedings, but occasionally also for criminal matters. None of this has ever had anything to do with retail loss prevention, as I'm not in that business, so I have no personal experience with what happens in court as regards shoplifting cases.

I've been on jury duty a few times, and even in a misdemeanor case.

I'm not sure if whether I've served on a jury really holds any bearing on whether I properly understand the state's burden in a criminal proceeding. I'm no lawyer, but I am pursuing paralegal certification in conjunction with earning my degree in political science (which is a degree earned through the college of law), so I feel more than qualified to talk about such low-level interpretation of basic US law. This stuff is, quite literally, what you study in law 101. Beginning law students are already well beyond such basic material when they begin pursuing their Juris Doctor.

Shosh, I have studied law. And yes, the stuff we're debating here is indeed basic law 101. Having passed that course, with good grades, I feel more than qualified. I don't need to ask anybody. The reason I keep disagreeing with you is because you are still wrong.
